From time to time in this Privacy Policy we will refer to (i) the Shimmer Boutique website, associated with the uniform resource locator (URL) www.ShimmerBoutiqueOnline.com/ as the “Site” or the “Shimmer Boutique Site”, (ii) ourselves as Shimmer Boutique, “us” or “we”, and (iii) Users and Visitors, to the Site as “you” or “Visitor,” as such terms are defined in the Term of Use Agreement.

Shimmer Boutique is not responsible for the privacy practices or the content of any third party websites to which the Shimmer Boutique Site or which link to the Shimmer Boutique Site.  By clicking on a link, logo or any item associated with a third party site, please note that you may be exiting the Site and the protections afforded by this Privacy Policy.  Your selection of any link associated with an entity or website other than the Shimmer Boutique Site, is a link to a third party website or entity that is outside of our services and beyond of our control.  These third party websites or entities may be governed by their own privacy policies, may send their own cookies to you, or may collect your Personal Information.  We urge you to review carefully the privacy policy of any such third party website or entity prior to accessing or using their services, or providing any of your Personal Information to them.

Changes to this Privacy Policy.  We may update this Privacy Policy from time to time and will keep you informed of such updates whenever they occur.  When we make changes to this Privacy Policy, we will post the updated Privacy Policy on the Site.  We encourage you to review the changes to the Privacy Policy and you agree that your continued use of the Site or the App after such changes are made will signify your consent to the new terms of this Privacy Policy.  We therefore recommend that you refer to this Privacy Policy regularly.  If the Effective Date has changed since your last review, please review the Privacy Policy in full for any changes.  Such changes will be effective upon posting on the Site.

II. Personal Information We Collect

Shimmer Boutique collects Personal Information from you or your device that enables Shimmer Boutique to provide a variety of services to you and other Visitors to the Site and to improve our services over time.  We collect Personal Information that you provide to us and we collect Personal Information when you access the Site or any services provided through the Site.

A. Personal Information You Provide to Us.  When you register with or update your account through the Site, you may provide your contact information that we will use to set up or update your account, such as, for example, your name, postal address, email address, website address, and telephone number and payment information (credit card type, number, and expiration date) (collectively, your “Contact Information”).  You will provide us or we will assign you certain access credentials that we will use for security purposes, such as to authenticate your identify each time you login to the Site, including one or more of the following: a user name, a personal identification number (“PIN”), a password, responses to security questions, and biometric information (e.g., picture of your face) (collectively, your “Access Credentials”).  After your account is set up, you may provide context information that we may use to create or update your Profile that identifies one or more of: your gender, ethnicity, interests or hobbies, education level, place of employment, marital status, place and/or date of birth (collectively, “Context Information”).  We may use your context information to provide certain services to you such as targeted advertising, promotions, or information based on your age, gender, interests, etc.  [your website may not be this sophisticated, but if you contemplate such a capability in the near future, it doesn’t hurt to leave this in]

B. Personal Information We Collect When You Use Our Services.  We may collect Personal Information in connection with the services that you use such as the websites that you visit; location information associated with your device, etc.  This information may include the following:

1.Device Information.

When you use or access the Site, we may collect information associated with the device with which you are communicating such as your wireless mobile device, tablet computer, laptop computer, desk top computer, or the like.  Such device information may identify the make and model of your device; type of browser you are using, the type or version of your operating system; approximate location of your device, unique device identifier(s), such as an electronic serial number (ESN), international mobile equipment identify (IMEI) number, a mobile equipment identifier (MEID), an Internet Protocol (IP) address, or a media access control (MAC) address. We may also collect information associated with you as a subscriber to a service provider such as your mobile directory number (MDN), landline directory number (LDN), subscriber identity module (SIM) uniform resource identifier (URI), mobile subscriber integrated services digital network (MSISDN) number, or the like.  We may use the device information for security purposes such as to authenticate your identify or that of your device and/or to optimize the resolution, aspect ratio or content that is provided by the Site for display on your device.

2.Usage / Purchase History.

When you access the Site, we may automatically collect and store certain Personal Information regarding web pages visited, items selected, purchases made, quantity of merchandize purchased, amount paid, etc.

3.Cookies.

We may collect and store information when you access the Site or use any of the services, and this may include sending one or more cookies or anonymous identifiers to your device. We also use cookies and anonymous identifiers when you interact with our services we offer to our partners, such as advertising services. For example, we may use an outside advertisement server company to display ads on our site.  These ads may contain cookies. The advertisement server company may collect cookies received with outside banner ads. We do not have access to information that would confirm the use of cookies by the advertisement server company.

4.Other Data and Changes to this Privacy Policy.

We may also require other information for tracking or verifying compliance with our policies, abiding by federal, state and local laws and for editorial and feedback solicitation purposes.  In addition, from time to time, we may use your Personal Information for new, unanticipated uses, such as notification of new services, announcements and general communications.  If our information practices materially change at some time in the future, we will post such change to the Site before we use your Personal Information for these new purposes, in accordance with the Section I.C of this Privacy Policy.

C. Grant of License.  Subject to the terms and conditions of this Privacy Policy and the Terms of Use Agreement, by accessing the Site or using the services made available via the Site, you acknowledge, consent to, and hereby grant to Shimmer Boutique a perpetual, non-exclusive, fully paid-up, and royalty-free license to use, display, modify, obfuscate, encode, translate, copy, transmit, or sublicense your Personal Information throughout the universe for our own commercial, research, and quality improvement purposes.

III. USE OF PERSONAL INFORMATION

A. Your Consent.  By registering with or updating your account with the Site, you are expressly and voluntarily accepting the terms and conditions of the Shimmer Boutique Terms of Use and this Privacy Policy and are freely accepting and agreeing to our use of your Personal Information in accordance with this Privacy Policy.  You further acknowledge and agree that your use of our services or providing your Personal Information to us, including any information deemed “sensitive” by applicable law, is entirely voluntary on your part.

B. Withdrawal of Consent; Termination of Account.  You have the right to withdraw your consent by requesting that your account be terminated and discontinuing access or use of the Site or services.  When you request that your account be terminated, Shimmer Boutique will first disable your account by making it unavailable and unviewable by you.  Shimmer Boutique will maintain your account in the disabled state for a period of thirty (30) days (the “Disabled Period”) during which time Shimmer Boutique will store your Personal Information to permit you to restore the account in the event it was accidentally or wrongfully terminated.  After the expiration of the Disabled Period, Shimmer Boutique may begin permanently deleting your Personal Information from our systems.  Notwithstanding the foregoing, Shimmer Boutique reserves the right to retain some or all of your Personal Information if, in our sole discretion, we determine that it is reasonably necessary to comply with applicable law, our legal obligations, meet regulatory requirements, resolve disputes, prevent fraud and abuse, or enforce this Privacy Policy and the Terms of Use.

C. Personal Information Uses.

1.Our Internal Use.

We use your Personal Information for our own internal purposes including providing the services to you, improving our services, recording and analyzing how and the amount to which Users use the Site and the services.

2.Our Communications to You.

We communicate with you through email, text messages, short message service messages, or notices posted on the Shimmer Site.   We may also, from time to time, send you messages to inform you about how to best use the services, new features of the Site; security warnings, planned service disruptions, or promotional and advertising content associated with Shimmer Boutique and/or a third party provider of goods and services.  Such messages and content will be sent to you based on your usage history, purchase history, context information, etc.  You may opt out of receiving such communications in accordance with Section V of this Privacy Policy.

3.Third Party Communications.

We do not share your Personal Information with any third parties, except as described in this Privacy Policy.  Except as specified to the contrary in Section III.B.4 and Section IV, we will not disclose your Personal Information that is generated or collected through your access to the Site use of the services without your consent or when carrying out your instructions (for example, to process your payment information).

4.Communications in case of Harm or Compliance with Law.

We may disclose your Personal Information in special cases when we believe in good faith that such disclosure is necessary to identify, contact or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) our rights or property or the rights or property of our members or others.  We also may disclose your Personal Information when we believe in good faith that the law, legal process or a lawful investigation requires it.

IV. SECURITY 

We exercise great care in providing secure transmission of your Personal Information between your device and our servers or those of a third party.  We also take great care to protect your Personal Information that is stored off-line.  All of your Personal Information is handled only by Shimmer Boutique authorized personnel or personnel of third parties that are authorized by us.  Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure, and we will not be held liable should a third party illegally obtain your Personal Information following delivery or prior to receipt of your Personal Information by Shimmer Boutique.  While we have made a great effort to protect your Personal Information, we cannot ensure or warrant the security of any information you transmit to or from us, and you do so at your own risk.

v. UNSUBSCRIBING; OPTING OUT

In the event you do not wish to receive communications, promotions, or advertisements from us or our partners, you may send a request to opt-out or unsubscribe from receiving such communications by selecting the Contact Us section of the Site.

VI. PUBLIC FORUMS 

This Site provides chat rooms, forums, and/or message boards to its users.  Please remember that any information that is disclosed in these areas becomes public information and you should exercise caution when deciding to disclose your Personal Information.
